In the previous post concerning the number of Notices of Trustee’s Notices filed in Clark County, Nevada, we saw a significant increase in June & July that suggests more bank owned homes are on the way for Clark County.

As of 09/01/09.. the following numbers are from the Las Vegas MLS. (Bank Owned Homes available for sale under Residential real estate for areas 101 – 606 which includes North Las Vegas, Henderson and Summerlin Homes.)

  • 11,334 Total Properties available for sale
  • 2,479 Listed as Bank Owned Properties

Of the 2,479 Listings classified as Bank Owned Homes in Las Vegas, North Las Vegas and Henderson:

  • 1,899 are classified as Single Family Residences
  • 395 are classified as condominiums
  • 169 Townhomes
  • 15 Manufactured Homes

Quite a significant decrease from past Las Vegas Bank Owned Homes reports.

Clark County Nevada Notice

of Trustee’s Sales

Through July of 2009

In my previous post I covered the chart of the Number of Notice of Defaults filed in Clark County that was provided by First American Title of Nevada that you can read by clicking the following link: Notice of Defaults for Clark County, Nevada.

Through July of 2009, the chart to the right shows the number of Notice of Trustee’s sales that have been filed in Clark County, Nevada. Once this is filed and a date is scheduled, the real estate owner has another 30 days before the scheduled sale and the Mortgagee takes title to the property.

Once the Mortgagee takes title, they then file a Notice to Quit to insure the legal process of evicting homeowners is followed. (Generally.. homeowners that have stayed past the actual Trustee’s sale have another 30 days.)

Obviously… you’ll notice the sudden increases that took place in June and July of 2009. This is partially due to the foreclosure moratoriums that took place and delayed the foreclosure process that was mentioned in a post I did back in February.

The latest numbers being reported for the number of Notice of Trustee’s sales being recorded is suggesting that more Bank Owned Homes in Clark County are on the way as the Banks get them ready for sale.

Remember the time frame of what happens after a Notice of Trustee’s sale is filed. Also keep in mind that the $8,000 tax credit for new homeowners is set to expire on December 1st. (Homes must close by November 30th for new homeowners to take advantage of this program.)

First American Title just sent out some pretty neat Foreclosure charts via e-mail to Las Vegas Realtors® that shows the trends for Foreclosures in Clark County, Nevada.

Notice of Defaults are the first stage of the Foreclosure process in Nevada. The chart to the right shows the trends that have taken place so far this year.

You’ll notice a pretty significant drop off of the number of Notices of Defaults filed in Clark county for July of 2009.

Once a Notice of Default has been filed on a home in Clark County, NV… you generally have another 120 days before the servicer can go on to the next step and file a Notice of Trustees Sale.
Something to keep in mind here… Just because a Notice of Default has been filed does not automatically mean that the home will end up Bank Owned. Out of all of these Defaults… many of them could be in the process of a loan modification or a short sale.

I personally have a couple of approved Las Vegas short sales that have Notices of Defaults filed on them that will be sold and reported as short sales.

When the gloom and doom media singles out Las Vegas and reports that Las Vegas has the highest foreclosure rate… keep in mind they are using a percentage based statistic. There are parts of the country that have more foreclosures taking place.

Remember – Foreclosure is the process. Bank Owned is when the Lender actually owns the home.

I first heard this commercial on a mainstream radio station in Las Vegas by a Las Vegas real estate broker and it really made me wonder. There has been some mention of this practice going on where some agents representing banks in listing their properties for sale are holding out and trying to get both sides of the deal.

While there has long been some speculation that this has been happening… it’s the first time that I actually came across it openly advertised and it really makes you wonder if the Bank being represented is really getting the most value possible for it’s investors.

Anybody in real estate that understands the system will tell you that the NUMBER one way to get the MOST Money for your home in the SHORTEST amount of time is the Multiple Listing Service aka MLS.

So… how can this practice of advertising for buyers by giving them first access to Las Vegas Bank Owned Homes be in the best interest of the client they are representing?

IT’S NOT.

Great for Marketing for a double commission but it certainly is not in the best interest of the seller.

I don’t know… maybe it’s just me but if I was an Asset Manager for this particular Bank I certainly would not be too happy.

Las Vegas Takes Top Spot Again

From CNN Money – Las Vegas Tops Foreclosure List in latest report that you can Read Here.

The 26 cities with the highest foreclosure rate in the nation are all located in four hard-hit states, with Las Vegas topping the list, according to a report released Wednesday.

It’s really no surprise considering the foreclosure moratoriums that were put in place while new help for homeowner programs were being created and delaying the correction process in cities such as Las Vegas where many Las Vegas homeowners would not qualify for the program due to the enormous amount of equity already lost.

From the Article:

“The concentration of troubled metro areas within the hardest-hit states, candidly, was even more severe than we expected it to be,” Sharga said. “The degree to which those four states dominated the rankings surprised even us.”

What’s not being reported is the number of Las Vegas Homes currently in escrow or the big jump in sales currently taking place for Las Vegas Real Estate.

As of today… there are 10,723 properties in either a “contingent” or “pending” status on the Las Vegas MLS for areas 101 through 606 which covers Las Vegas, Henderson and Summerlin.

Only 16,902 single family residences are currently available in the same areas… some more proof of a theory from my last Las Vegas Foreclosure Report that values may be stabilizing from the free fall.

Remember… without buyers you can’t have a healthy real estate market… No matter what programs are in place.
